This website and online store are operated by Custom Gazebos. Throughout these Terms of Service, the words “we”, “us” and “our” refer to Custom Gazebos.
These Terms of Service explain the conditions that apply when you access our website, contact us, request artwork, place an order or purchase products from us.
By using this website, submitting an order, approving artwork or purchasing from us, you agree to these Terms of Service and the policies referenced on this website.
Please read these Terms carefully before placing an order. Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Australian Consumer Law.

Custom Gazebos supplies custom printed gazebos, branded marquees, printed replacement canopies, gazebo walls, gazebo frames, accessories and related outdoor display products throughout Australia.
2. Eligibility and Acceptable Use
By using this website, you confirm that you are at least the age of majority in your state or territory of residence, or that you have permission from a parent or legal guardian.
You agree to provide complete, accurate and current information when placing an order, including your:
- Name and contact information;
- Billing information;
- Delivery or pickup information;
- Selected products and quantities;
- Artwork files; and
- Any other information reasonably required to complete the order.
You must not use our website, products or services for an unlawful, fraudulent, harmful or misleading purpose, or in a way that infringes another person’s rights.
3. Products and Product Information
We supply both custom-made products and standard non-custom products.
Custom products may include:
- Custom printed gazebo roofs and canopies;
- Custom printed gazebo walls;
- Custom printed valance banners;
- Complete branded gazebo packages;
- Printed banners, flags and table covers; and
- Other personalised promotional display products.
Non-custom products may include:
- Gazebo frames;
- Replacement components;
- Weights and anchoring accessories;
- Carry bags;
- Hardware; and
- Other standard accessories.
We make reasonable efforts to ensure that product descriptions, dimensions, photographs, specifications, prices and availability are accurate.
Product images, illustrations and digital mockups are provided as a visual guide. The final product may vary slightly because of fabric movement, lighting, screen settings, printing processes, stitching, finishing and normal manufacturing tolerances.
Minor variations that do not affect the product’s normal function or overall appearance do not automatically mean that the product is faulty.
4. Product Suitability
Before placing an order, customers are responsible for reviewing the product description, dimensions, specifications, intended use and included components.
Please contact us before ordering if you are uncertain whether a product is suitable for your intended purpose, location, event or existing gazebo frame.
A replacement printed canopy may not fit every gazebo frame. Where a customer orders a replacement canopy for an existing frame, the customer is responsible for providing accurate frame dimensions and compatibility information.
Any product recommendation we provide will be based on the information supplied by the customer.
5. Artwork Files and Customer Responsibilities
Customers are responsible for supplying suitable artwork and having permission to use all logos, trademarks, photographs, illustrations, text and other materials submitted for printing.
By supplying artwork, you confirm that:
- You own the artwork or have permission to use it;
- The artwork does not infringe another person’s copyright, trademark, privacy or other rights;
- The information shown in the artwork is accurate; and
- We are authorised to reproduce the artwork to complete your order.
We may decline artwork that appears unlawful, misleading, offensive, defamatory or likely to infringe another party’s rights.
6. Artwork Proofs and Approval
Where applicable, we will provide a digital artwork proof or mockup before production begins.
The customer is responsible for carefully checking all artwork details, including:
- Spelling and grammar;
- Names, telephone numbers, email addresses and website addresses;
- Logos, photographs and graphics;
- QR codes;
- Colours;
- Product size and quantity;
- Artwork orientation;
- Print placement and layout; and
- Any other information shown in the proof.
Production begins after the final artwork has been approved and the required payment has been received.
Once artwork has been approved, we are not normally responsible for customer-supplied errors that were reasonably visible in the approved proof.
This may include spelling mistakes, incorrect contact information, incorrect logos, unsuitable customer-supplied images, QR code errors or layout preferences approved by the customer.
If a reprint is requested because of an error in the approved artwork or customer-supplied file, additional charges may apply.
If the completed printing does not match the final approved artwork because of our production error, we will assess the issue and provide an appropriate remedy.
7. Technical Artwork Adjustments
We may make minor technical adjustments to artwork where reasonably necessary for production.
These adjustments may include:
- Scaling and positioning;
- Adding bleed;
- Adjusting sewing margins;
- Setting up colour profiles;
- Preparing cutting or print files; and
- Other minor production adjustments.
We will not intentionally make a material change to the approved design without contacting the customer.
8. Printed Colours
Colours displayed on a phone, monitor or other screen may appear different from colours printed on fabric.
RGB, HEX and screen colours cannot always be reproduced exactly through commercial fabric printing.
Where colour matching is important, the customer should provide a Pantone Solid Coated colour reference before approving the artwork.
Although we will make reasonable efforts to match a supplied Pantone reference, minor variation may still occur because of the fabric, ink, printing method, lighting and finishing process.
A small and reasonable colour variation is not normally considered a production fault unless a specific colour-matching standard was agreed by us in writing before production.
9. Orders and Order Acceptance
Submitting an order is an offer to purchase the selected products subject to these Terms.
An automated order confirmation confirms that we have received the order. It does not necessarily mean that production has started.
We may contact the customer if:
- Artwork is missing or unsuitable;
- Product selections are incomplete or incompatible;
- The delivery information is incomplete;
- A product is unavailable;
- A pricing or website error has occurred; or
- Additional information is reasonably required.
We may decline or cancel an order where we cannot reasonably supply it, where payment cannot be verified, where unlawful or infringing artwork has been submitted, or where there is an obvious pricing or product-information error.
If we cancel an order before supplying the product, we will refund the amount paid for the cancelled product unless another solution has been agreed with the customer.
10. Prices, GST and Currency
All prices are shown in Australian dollars unless otherwise stated.
The website will clearly identify whether a displayed price includes GST. The total price payable, including applicable GST and shipping charges, will be displayed before the customer completes payment.
For products offered to the general public, the GST-inclusive price should be displayed prominently on the relevant product page.
Any discount or promotion is subject to its stated conditions and availability.
Shipping charges are calculated and displayed during checkout after the customer enters the delivery address.
We will not add an additional remote-area or oversized-product charge after checkout based only on the customer’s location.
Additional costs may apply only where the customer changes the order, products, quantity, delivery address or delivery method after checkout, or where redelivery is required because of information or access conditions within the customer’s control.
11. Payment
The available payment methods will be shown during checkout.
Payment must be successfully completed before standard non-custom products are dispatched and before production begins for custom-made products, unless we have agreed otherwise in writing.
The customer is responsible for ensuring that payment and billing information are correct.
If payment is reversed, declined, disputed or otherwise unsuccessful, we may pause production or dispatch until the matter is resolved.
12. Processing and Production Times
Custom Products
Custom printed and personalised products are normally ready for dispatch within 5–7 working days after:
- Full payment has been received; and
- The final artwork has been approved by the customer.
Production cannot begin until both requirements have been completed.
Non-Custom Products
Standard non-custom products that are in stock are normally processed and ready for dispatch within 1–2 working days after payment has been received.
Working days are Monday to Friday, excluding Australian public holidays.
Processing and production times are separate from courier delivery times.
13. Urgent Orders
Urgent or same-week production may be available for selected products, depending on production capacity, order size and delivery destination.
Urgent production must be approved by us in writing before the order is placed or production begins.
Any additional urgent-production or express-delivery charge will be disclosed before the customer confirms the service.
Choosing express delivery does not shorten the production time unless urgent production has also been approved.
14. Shipping and Delivery
We deliver throughout Australia. Shipping availability and charges are calculated using the address entered during checkout.
The total estimated order timeframe consists of the applicable processing or production time plus courier delivery time.
Courier delivery times may vary depending on the destination, carrier network, public holidays, severe weather, peak delivery periods and other circumstances outside our reasonable control.
Customers with a fixed event date should contact us before ordering so we can advise whether the requested timeframe is reasonably achievable.
Customers are responsible for providing an accurate and complete delivery address.
Reasonable redelivery, redirection or return-to-sender charges may apply where delivery cannot be completed because of an incorrect address, unavailable access or another matter within the customer’s control.

15. Free Local Pickup

Customers must wait until we confirm that the order is complete and ready for collection before arriving at the pickup address.
Collection instructions and available pickup times will be provided when the order is ready.
16. Custom Products, Changes and Cancellations
Custom products are made specifically for each customer using the selected product options and approved artwork.
Customers should contact us immediately if they need to request an order change or cancellation.
Before artwork approval or production begins, we will make reasonable efforts to accommodate a requested change or cancellation.
Once final artwork has been approved or production has started, an order may not be changed or cancelled because materials, printing or manufacturing work may already have been committed.
Where we agree to a change after production preparation has started, the customer may be responsible for reasonable costs already incurred. These costs will be explained before the change proceeds.
Nothing in this section limits any rights available under the Australian Consumer Law.
17. Returns, Replacements and Refunds
Custom-made products cannot normally be returned or refunded because of a change of mind once artwork has been approved or production has started.
Standard non-custom products may be eligible for a discretionary change-of-mind return only where the return is approved by us in writing and the product is unused, unassembled, undamaged and in its original packaging.
This does not affect the customer’s rights where a product is faulty, damaged, incorrectly supplied, not as described or does not match the approved artwork because of our error.
Depending on the nature of a confirmed issue, an appropriate remedy may include:
- Repair;
- Replacement parts;
- A replacement product;
- A reprint;
- A partial refund; or
- A full refund.

18. Reporting Faults, Damage or Incorrect Orders
Please inspect your order promptly after delivery.
Where possible, contact us within 7 days if you notice:
- Shipping damage;
- Missing components;
- Faulty hardware;
- An incorrect item or quantity; or
- Printing that does not match the approved artwork.
Please provide your order number, a clear explanation of the issue and photographs or videos showing the product, packaging and affected area.
The requested notification period helps us investigate delivery and production issues promptly. It does not limit any rights or remedies available under the Australian Consumer Law.
19. Product Installation and Safe Use
Gazebos and outdoor display products must be assembled, secured, used and stored safely.
Customers are responsible for:
- Following any supplied assembly and safety instructions;
- Checking that all components are correctly installed;
- Using suitable weights, pegs, ropes or anchoring methods;
- Monitoring weather and site conditions;
- Ensuring that the installation does not create a hazard; and
- Obtaining any permit or approval required for the location.
Gazebos should not be used in strong wind, storms, extreme weather or other unsafe conditions.
The amount and type of anchoring required depend on the product, ground surface, installation location and weather conditions.
20. Damage, Wear and Maintenance
Unless otherwise required by law, damage caused by the following is not normally considered a manufacturing fault:
- Incorrect assembly or installation;
- Insufficient anchoring or weighting;
- Strong wind, storms or extreme weather;
- Misuse, accidents, negligence or vandalism;
- Unauthorised modifications or repairs;
- Improper storage;
- Continued outdoor exposure;
- Fading caused by sunlight and weather; or
- Normal wear and tear.
This section does not exclude liability for a fault that existed when the product was supplied or any right protected by the Australian Consumer Law.
21. Intellectual Property
Unless otherwise stated, the website content owned by or licensed to Custom Gazebos includes:
- Website text and product descriptions;
- Photographs and graphics;
- Product mockups;
- Templates;
- Logos and branding;
- Website layouts; and
- Other original content.
This content may not be copied, reproduced, republished, distributed, scraped, resold or commercially exploited without our prior written permission, except where permitted by law.
Ownership of customer-supplied artwork remains with the customer or the relevant rights holder.
22. Third-Party Services
Our online store is hosted by Shopify, which provides the ecommerce platform used to offer products and process online orders.
We may also use third-party providers for:
- Payment processing;
- Courier and delivery services;
- Website hosting and functionality;
- Analytics;
- Customer communications; and
- Other business services.
A purchase made through this website is a purchase from Custom Gazebos, not from Shopify.
Third-party services may be subject to their own terms and privacy policies.
23. Privacy
Personal information submitted through this website is handled in accordance with our Privacy Policy.
Information may be processed by Shopify, payment providers, couriers and other service providers where reasonably required to process payments, produce orders, arrange delivery, provide customer support and operate the online store.
24. Website Errors and Product Availability
Website information may occasionally contain a typographical error, technical issue, inaccurate description, incorrect price or availability error.
We may correct inaccurate information when it is identified.
If an error materially affects an order that has already been placed, we will contact the customer before proceeding.
The customer may choose to accept the corrected order information or cancel the affected product for a refund of the amount paid for that product.
25. Website Availability
We make reasonable efforts to keep the website available, accurate and secure.
However, we do not guarantee that access will always be uninterrupted or that the website will be completely free from technical errors.
Website access may occasionally be interrupted because of maintenance, hosting issues, internet disruption or other circumstances outside our reasonable control.
26. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies:
- A consumer guarantee;
- A right or remedy under the Australian Consumer Law; or
- Any other right or remedy that cannot legally be excluded, restricted or modified.
Where there is a major failure, customers may be entitled to reject the goods and choose a refund or replacement, together with compensation for reasonably foreseeable loss or damage where applicable.
Where a failure is not major, we may be entitled to provide a repair, replacement or another appropriate remedy within a reasonable time.
27. Liability
To the extent permitted by law, neither party will be responsible for indirect or consequential loss that was not reasonably foreseeable when the order was placed.
We are not responsible for delays caused solely by circumstances outside our reasonable control, provided that we take reasonable steps to reduce the effect of the delay and communicate with the customer where appropriate.
Nothing in these Terms limits our responsibility for:
- Fraud or deliberate misconduct;
- Personal injury caused by negligence where liability cannot be excluded;
- A breach of an applicable consumer guarantee; or
- Any liability that cannot legally be excluded or limited.
28. Customer Responsibility for Supplied Content
The customer is responsible for claims arising directly from artwork or content supplied by the customer where:
- The customer did not have permission to use the material;
- The material infringes another party’s rights;
- The customer supplied false or misleading information; or
- The customer requested an unlawful use of the material.
This responsibility applies only to the extent that the claim was caused by the customer-supplied content or instructions.
29. Complaints and Disputes
Please contact us first if you have a concern about an order, product, payment, delivery or service.
We will make reasonable efforts to review the matter and work with you toward an appropriate solution.
When contacting us, please provide your order number, contact details and a clear explanation of the issue.
30. Governing Law
These Terms are governed by the laws of New South Wales and the applicable laws of Australia.
Nothing in this section prevents a customer from exercising rights or accessing a court or tribunal available under applicable consumer protection laws.
31. Changes to These Terms
We may update these Terms when reasonably required to reflect changes to our products, website, business operations or legal obligations.
The current version will be published on this page with the latest revision date.
The Terms that applied when an order was placed will continue to apply to that order unless a change is required by law or agreed with the customer.
